Problems of legal liability for illegal hunting

Abstract

The article deals with theoretical questions related to the investigation of legal liability issues for offenses in the hunting area. Attention is drawn to the weakness of the legal liability institute, as one of the main factors defining the country current environmental situation.
In the process of bringing the requirements of national legislation in line with international standards it is allocated the value of environmental and legal studies conducted by taking into account native approaches to rulemaking and foreign regulation of relations experience in the use and reproduction of natural resources, environmental protection, environmental safety.
Characterized the current state of regulatory support restoration of the rights of users of hunting grounds in the course of bringing to criminal and administrative liability of persons who have committed offenses, as a result of which an illegal production of objects of fauna occurred.
It is concluded that in the field of protection the rights of the users of hunting grounds ecological legislation on the legal responsibility for violations in the field of hunting outpace the development of criminal legislation and legislation on administrative violations, whose norms contain provisions on the confiscation of extracted objects of fauna, that hinders the restoration of the rights for users of hunting grounds for these objects
